One honest sentence: the Court said Black Americans could not be citizens; after the war the Constitution said they could. Do not ask whether Lincoln meant the 14th.

Hear the Bliss text

Four score and seven years ago our fathers brought forth on this continent, a new nation, conceived in Liberty, and dedicated to the proposition that all men are created equal. Lincoln spoke about two minutes at Gettysburg, 19 November 1863. The Bliss copy (1864) is the signed, dated text on the Lincoln Memorial. He did not dash it off on a train. The speech claims the Declaration as a proposition, the war as a test, unfinished work, a new birth of freedom. It does not create citizenship, due process, or equal protection. It does not repeal three-fifths.

Then the rule

Five years later, after Lincoln is dead, Section 1 writes a membership rule and restraints on the states. Dred Scott (1857) had held that people of African descent could not be citizens of the United States within the meaning of the Constitution. Section 1's first sentence does not argue with Taney. It replaces him. If someone says Gettysburg is the 14th, put both texts on the table.

Big idea

Gettysburg is a proposition over graves. The 14th is an instrument. Read both. Do not swap them.
