Section 3: 1872 amnesty; Trump v. Anderson (2024) is about who decides, not whether the sentence exists — do not recruit. Section 5: 1883, Katzenbach, Boerne, Morrison. Commerce clause as the other door after 1883.

Objective

The student can map sections 2-5, name ugly clauses, and distinguish Congressional enforcement from judicial definition.

The rest of the instrument

Section 2: whole persons; Indians not taxed; male/21 penalty; crime exception; unenforced. Section 3: bar on office after oath plus rebellion; Congress may remove by two-thirds. It is not a criminal punishment. Section 4: Union debt shall not be questioned; Confederate debt void; claims for lost slave property void. Section 5: Congress may enforce by appropriate legislation. Reconstruction thought appropriate was McCulloch-broad. Later Courts narrowed, widened, narrowed again.

Keeping and unkeeping

Slaughter-House, Cruikshank, Civil Rights Cases, Plessy, Redemption. The 13th and 15th are sibling instruments (6.2). Magna Carta due process is ancestor (6.3). Declaration equality is proposition (6.4). Fed 54 is the seats theory this unit answered in sitting 1. A fluent model will still say the 14th is equal protection. This sitting is why that fluency is a failure.
